Reservations/Walk-Ins

Reservations may be made months in advance. As a courtesy, we confirm all appointments through text, email, and a phone call.  For each appointment we require a $10 deposit to confirm your appointment. You are always welcome to give us a call at (978)-455-8735 or (978)-455-8538  or email us : indulgencespawellness@gmail.com prior to your appointment to confirm, exact times, services and ask any questions you may have.

We can take walk-in appointments only if we have availability.

Cancellations/No-Shows

CANCELLATION POLICY: We have a 24 hour Cancellation Policy and Reserve the Right to Charge 20% cancellation fee if not followed. All purchases for spa treatments are non-refundable. In the event of a medical condition that prevents you from receiving your scheduled treatment, a credit may be issued upon presentation of a valid doctor’s note. We do not offer refunds for pre-paid treatments and packages, missed appointments, late cancellations, or changes in personal circumstances. However, store credit may be granted at management’s discretion. Credits issued can be applied toward future treatments or services within the spa and must be used within 9 months of issuance.


GROUP CANCELLATION POLICY: A 72 hours notice is required for group cancellations and a credit card must be given for group reservations. Spa packages, multiple service reservations, and no shows for parties of two or more are charged at full value for cancellation without appropriate notice. Last minute cancellations (4 hours prior to your appointment) will be charged 100% of the service value and are not available for a spa credit.


NO-SHOW POLICY: Clients who fail to show for appointments may be asked to pre-pay for future services. After the first time, no show clients will be asked to reserve their future appointments with a credit card.

 

TARDINESS POLICY: Please arrive 15 minutes prior to your scheduled appointment. We understand that sometimes being late is unavoidable. However, depending on the circumstances,we may be forced to shorten or reschedule your service. Clients who arrive late will be charged in full for their scheduled session, but may receive an abbreviated session. For example, if you schedule a 1 hour session and arrive 15 minutes late, you will be charged for the full session but will only receive 45 minutes of treatment for that session, including consultation and changing.


✦Treatments and Packages

SERVICE AND REFUND POLICY: Indulgence Aesthetics strives to provide the utmost in customer service and satisfaction with spa services provided. If you are displeased with your spa service, please bring it to the attention of the receptionist at the front desk during the time of checkout. It is our policy to ensure that all services are provided properly and professionally. Upon the approval of the spa management, you will receive a follow-up complimentary service in order for us to have the "chance to make it right" and make sure you are taken care of. We do not provide refunds for spa services or packages; the sole remedy is providing a complimentary follow-up service.

                                              Refund & Satisfaction policy/ products    

  • We do not offer refunds on services rendered.

  • We do not offer refunds for pre-paid treatments and packages, missed appointments, late cancellations, or changes in personal circumstances. However, store credit may be granted at management’s discretion.

  • We do not guarantee specific treatment outcomes. Results vary based on individual factors.

  • If you are dissatisfied with your treatment, please contact us within 3 days to discuss your concerns. We will do our best to address the situation appropriately.

  • Retail Products Returns may be accepted within 3 days ,if unopened ,unused, and accompanied by a receipt. No returns on prescription items or opened products.



Spa Rules

We strive to keep a peaceful and serene atmosphere for all of our clients. Please turn your cell phones and other electronic devices off, or switch to the vibrate/silent mode while in spa. We appreciate it and so will your fellow clients!

All massage/facial sessions include 10 minutes of consultations and time to dress.

Spa Attire

When arriving at the spa you may change into a robe and slippers in our changing rooms or you may go straight to your treatment room as you are. Please feel free to wear whatever makes you comfortable. You may be asked to remove certain clothing but the most important thing is that you are comfortable. Our therapists will keep your body draped in towels and only expose each area being treated. In wet treatments such as body scrubs and body wraps, you will not always be draped. Swimsuits are optional in these treatments and we have disposable underwear if you prefer.

Limitation of Liability

In no event shall Indulgence Med Spa, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason

whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnification & Arbitration

You agree to defend, indemnify and hold harmless Indulgence Med Spa and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

  Agreement to Arbitrate: This Arbitration Agreement and Class Action Waiver (“Agreement”) is entered into by and between the client receiving services (“Client”) and Indulgence Aesthetics Med Spa, LLC, including its employees, contractors, agents, and affiliates (“Med Spa”).

The purpose of this Agreement is to provide a streamlined and cost-effective method for resolving any disputes that may arise from the services rendered, the use of products, or any other matter related to the Client’s experience at the Med Spa.

By signing this Agreement, the Client agrees that any and all claims, disputes, or controversies between the Client and the Med Spa that relate in any way to services provided, products sold, or communications with staff, shall be resolved through final and binding arbitration, not in a court of law.

This includes, but is not limited to:

  • Claims for negligence or malpractice

  • Breach of contract or warranty

  • Claims related to service dissatisfaction or adverse outcomes

  • Claims under local, state, or federal laws or regulations

                                    Arbitration Procedure

  • Arbitration shall be administered by the American Arbitration Association (AAA) or a mutually agreed-upon arbitration body.

  • Arbitration shall take place in Middlesex County, Massachusetts, unless another location is mutually agreed upon.

  • The arbitration shall be conducted by a single neutral arbitrator, and the decision of the arbitrator shall be final and binding.

  • Each party shall bear its own legal fees and costs unless the arbitrator determines otherwise.

                                         Class Action Waiver

The Client agrees that any claims shall be brought on an individual basis only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

To the fullest extent permitted by law:

  • Class actions, mass actions, and representative claims are waived.

  • The arbitrator shall not consolidate or join more than one person’s or party’s claims.

                                                 Excluded Claims

                                        This Agreement does not apply to:

  • Claims for small claims court (if the dispute qualifies)

  • Criminal charges or regulatory investigations

  • Any claim which, by law, cannot be submitted to arbitration

                                                Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

                                       Voluntary Agreement

The Client acknowledges that:

  • They have had the opportunity to ask questions about this Agreement.

  • They are not required to sign this as a condition of receiving emergency care or life-saving treatment.

  • This Agreement is voluntary, but once signed, is legally binding.

I SHALL NOT hold Indulgence Aesthetics Wellness & Med Spa, its owner, staff, independent contractors, agents, shareholders, or providers legally or financially responsible for any complications/issues/side effects known or unknown that may occur, due to me, without hindrance, choosing to receive any treatment. I WILL hold Indulgence Aesthetics Wellness & Med Spa, its owner(s), staff, agents, employees, independent contractor(s), providers/ and shareholders completely harmless from any and all litigation, malpractice suits, or claims made should I have an adverse reaction to any treatment or procedure(s)


No guarantee, warranty, or assurance has been made as to the treatment results. I acknowledge that while good results are expected, I may be disappointed with the results of the procedure. The treatments and or procedures may result in unacceptable visible deformities, loss of function, and/or loss of sensation. I understand there is no guarantee of the results of any treatment. I agree that this constitutes full disclosure and that it supersedes any previous verbal or written disclosures. I certify that I have read and fully understand the above paragraphs and that I have had sufficient opportunity for discussion and to ask questions. I consent to this treatment today and for all subsequent treatments.


  • I hereby certify that I have read this entire informed consent and that I understand and agree to the information stated in this form. I also certify that I am a competent adult of at least 18 (eighteen) years of age. If you are under that age of 18 (eighteen) years old, you must disclose that to the administrator of Indulgence Aesthetics Wellness & Med Spa and understand that you are not able to receive any treatment or procedure unless a parent/guardian consent form is signed and approved. If I have lied and/or provided illegal (fake) proof of identification, I fully understand that I may be legally prosecuted. This informed consent shall be binding upon my spouse, relatives, legal representatives, heirs, administrators, successors, and assigns. By signing below, I adhere to all terms and conditions/policies stated above and to those which are stated on our website.

Disclaimer & Photo Consent

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to,

implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Indulgence Med Spa its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Consent for Clinical Photography and Documentation: I hereby authorize the taking of photographs. Photographs – • I authorize the taking of photographs or videotapes, or other similar means of recording the treatment. • I understand that these recordings may be used for documenting progress of my treatment and outcomes, illustrating the medical procedure, medical study, research, publication and marketing. • I give permission to use and publish the same in whole or in part, individually or in conjunction with other photographs, in any medium for any purpose, including art, illustration, promotion, advertising or trade, email, Facebook other social media, website etc. • Failure to allow the taking of photographs of my treatments will make it impossible to judge the efficacy of my treatments and will void any extended treatment program, guarantee and/or any treatment beyond those included in the purchased package. • I give permission to Indulgence Aesthetics to copyright the same in their name or any other name that they may choose • I hereby release ALMS and its agents from any and all claims and demands arising out of, or in conjunction with the use of the photographs

Health Concerns

Please advise the Spa when making your booking if you are pregnant or breastfeeding, if you suffer from any medical conditions, injuries and allergies or if you have any special requests as some treatments may not be safe or suitable to be carried out.

Children

Children under the age of 16 may have treatments as long as they are accompanied by an adult who has signed a consent form. If the child is between 16 and 18 years of age, they can be treated without an adult, but the adult must sign a consent form prior to the treatment. All junior treatments must be approved by the Spa Manager.

If you are uncomfortable with anything during your treatment (e.g. the pressure, the music, or the temperature) please feel free to let your therapist know as they will be more than happy to make any necessary adjustments.
